Associate

Gonzague d’Aubigny is an associate at Teynier Pic.

He is experienced both in business litigation and in arbitration, and acts in pre-litigation negotiations and proceedings before French domestic courts (commercial and civil Courts, summary proceedings, enforcement judge, investigation and criminal Courts). He also has particular expertise in mediation procedures, whether pursuant to a contractual clause or a court decision.

Gonzague acts in various litigation matters, including in relation to shareholders’ and financial disputes, contractual and commercial disputes and industrial risks, in a variety of sectors, such as high-tech industries, digital tech and the financial sector.

Prior to joining Teynier Pic, Gonzague worked as an associate at a leading US law firm in Paris. He also clerked in the 16th chamber of the Commercial Court of Paris as a legal assistant in charge of drafting judgments.

  • Representing the former shareholders of a high-tech industrial company against transferees regarding a warranty clause (dismissal of all claims by the Commercial Court and the Paris Court of Appeal).
  • Representing a listed company in a dispute initiated by a former CEO challenging his dismissal (dismissal of all claims by the Commercial Court and the Paris Court of Appeal).
  • Representing a listed video game publisher against a competitor claiming compensation based on allegations of unfair competition (dismissal of all claims by the Paris Commercial Court).
  • Representing a website developer against a major hotel group refusing to pay the contractual price (obtaining the agreed compensation in full before the Commercial Court of Versailles, including overruns and late payment interest).
  • Representing the French subsidiary of a major US industrial group against claims for damages brought by a French competitor pursuant to a decision of the French Competition Authority (follow-on damages claims) (dismissal of all claims by the Commercial Court, the Paris Court of Appeal and the French “Cour de cassation”).
  • Representing a leading bank against a competitor claiming damages for manipulation of interbank rates (decision of lack of jurisdiction upheld by the French “Cour de Cassation”.
  • Representing the bondholders of a large group against its auditors before the civil and criminal courts.
  • Representing American investors in a tax fraud investigation and in criminal proceedings.
  • Representing a European industrial company in an ICC arbitration against an Egyptian client claiming damages (dismissal of all claims by the arbitral tribunal).
  • Representing several listed companies, shareholders and individuals, facing market abuse claims, before the Investigations Department and the Enforcement Committee of the French Stock-Market Authority (AMF) (insider trading, late disclosure, etc.).
  • Secretary to an ICC tribunal in a dispute between a European tour operator and an African tourism company invoking force majeure further to terrorist attacks.
