Draft reform of arbitration law in France

The French legal framework for arbitration law is set to change. In March 2025, the working group formed in the fall of 2024 submitted its report to Minister of Justice Gérald Darmanin.

One of the main proposals is the creation of a separate code of arbitration, distinct from the Code of Civil Procedure, with the aim of clarifying a set of rules that are currently scattered across several texts and increasing the international visibility of Paris as an arbitration center.

The draft is currently subject to criticism and proposals. Arbitration professionals have been invited to contribute.

On April 8, 2025, the Minister of Justice announced that the reform would be carried out in three stages:

  • Regulatory adjustments to clarify and modernize the existing framework.
  • Extensive consultation with lawyers, courts, and academics.
  • Creation of an arbitration code in the fall of 2026.
